Why did Mercedes not issue a recall on the shifting assembly?

What is your question?

It's well established that the shifting assembly was faulty on these cars.

Most all recalls are issued for safety issues not mechanical problems. That does not mean that there could be Technical Service Bulletin for that issue. TSBs are not sent to the public.
