Brake lights come on whenever the Ignition is on; motor running or not.
What makes this problem better or worse?

Hello, are you certain it's brake lights? Could it be the parking lights that are on? I don't know why brake lights could possibly correlate with the ignition being on or off. The circuit for brake light operation is independent of the ignition.
Then the brake lights should be on ALL THE TIME - - even while parked.
Brake light switch failure would be a prime suspect - switch always remains in the closed (ON) position.
Tried everything: even went to Mercedes yesterday. They scanned and could only guess the ESP. Exchanged new brake light switch with the one in wife's 430e. New one worked in hers; hers didn't work in my vehicle? Defiantly not switch.
