The brake light switch not by brake pedal on my 2003 ML350, where would it be?

My esp/bas light is on and won't go off. I tried replacing the fuse to the brake lights and that didn't fix it. I tried to buy a new brake light switch as I read that a faulty switch is often the culrpit. I watched youtube videos showing instructions to replace the brake light switch. IWhen I took the panel off covering the pedals, there is a mount for the switch next to the brake pedal just like on the videos, but in my car there is no switch installed. There is no wiring harness with a plug dangling or anything either. The brake lights do come on though when I depress the pedal and they seem to be working fine so there must be a switch somewhere right? Where else could it be located and if the brake lights are working ok then is it even worth replacing?
