What is your question?
while the engine is cold and in gear, the car may move faster than expected when the accelerator is not pressed. A soft ware update from honda will fix this concern. My question is is the soft ware update under warrenty?

As a general rule if your Honda is within 3 years and 36K of the delivery date then warranty will pay for it. The updates don't take that long and at my dealer I usually update the customers vehicle with either a minimum charge or no charge at all. This of course will vary from dealer to dealer.
