No codes no stalling and only when it warms up and only up until I get to about 45 mph it loses power when accelerating jerks and like coughs fluid is almost burnt looking and smelling so I'm assuming it's ran warm but it runs great cold and once I'm up to speed it has been running fine it feels like to is trying to lock in before it shift and I just notice last night it did not seem to lock in when on freeway still no codes no check engine light is it possible for it to be the TC no leaks no noises could it be failing and it somehow not throw a code.
What makes this problem better or worse?

Hello, your concern as described is hard to figure -- your torque converter is going to engage on cruise or extremely light throttle at about 35+ mph. Once engaged it locks in to maximize efficiency. Typical concerns with torque converters are shuttering and vibration. I've not heard much about a torque converter causing lack of power and acceleration. If your engine speed (RPM's) are going high but you are not accelerating, you could have a transmission concern. If your fluid is not clean - I'd recommend a fluid change regardless of concern or theory. "Throw a code" -- not all concerns generate diagnostic trouble codes (DTC's). But, torque converter clutch issues and engagement issues would very much trigger a code if they were off concern. www.repairpal.com/repair-shops
Actually the symptoms are more indicative of an ignition misfire. A good quality scan tool with misfire data would be invaluable.
