Can I sell my 2013 BMW X5 Diesel with an active Recall?

What is your question?

Recall for the "Engine Idler Pulley Bolt" still in flux. No telling when BMW will have a fix to this and it is costing me $, for a vehicle that is supposed to retain it's high value. Minor concern about driving and the car fails because of recall item. I am trying to get away from Diesel. Will someone be able to buy, legally, with the intent that it will be fixed at some point? Is there a point where we can consider this a "lemon" and take legal action?
