The transmission died on my 2013 BMW Active Hybrid. The mechanic said he would order a new transmission and put it in for 10k total. He wanted me to initially pay $7,500 before he ordered the transmission, which I did. He then said that the transmission did not fit the car so he ordered another one and that did not fit. Now he has spent over one month trying to get it re-manufactured. He says that the parts are difficult to find and that they order them, but do not know until they arrive if they are the right parts. I found the manufacturer he is using who confirmed his story. In the meantime I’ve accrued over $2,000 in rental car fees. How long do I wait? Are they not being straight with me and just wasting my time in hopes that these parts will turn up? Can I make them liable for rental car fees? Such as by only paying $1,500 of the remaining balance of $2,500. In other words, refusing to pay $1000 of what I owe because they should pay at least 50% of my rental car fees. PLEASE HELP!
Now IF you can ‘prove’ the repair shop is liable for the delay - then you ‘might’ have a case.
