Transmission Failure After replacing less than 4 tires on the 4x4 model on Nissan Pathfinder

The Owners Manual for the 4x4 Model Nissan Pathfinders eludes to the likeliness that the transmission will fail when using mismatched/mixed tire types, brands or sizes..... This is due to the type of hubs used for this vehicles "on the fly 4x4" option.... which keeps the hubs engaged, but not full-lock position, even when not in 4x4 mode! Just had a 95 Pathfinder SE 4x4 with 102,967 miles and a freshly busted up planetary gear due to the presence of two All-seasons and 2 M&S mode by two MFG's (Goodyear/Continental). Customer was not informed of the possible effects of running mixed tire types during the warranty replacement of a damaged tire, Sears replaced both tires on the axle of the damaged tire to lessen effects, but might as well have put two 275/65R15's and two 265/65/R15's., DONT MIX TIRES (and dont trust Sears Auto)
1994 Nissan Pathfinder - 4WD 145,762 mi,
Replaced only 2 rear tires with new tires that did not match the brand of the front tires and the front tires were half way worn, then the automatic transmission on my Nissan Frontier failed because of the differences between the 2 front/rear tires. COme to find out, the manual for the truck warned that the transmission would be damaged when all 4 tires werent matching in brand and tread type and size. Nissan told me that size also means tread wear that is not the same amount on all 4 tires means they are different sizes. Sears installed the tires even though I signed a waiver on a separate piece of paper that removed all liabilities from them in the event that I or my vehicle became damaged or injured as a result of their sompany installing "illegal tires". I ACCEPT FULL RESPONSIBILITY FOR GOING AGAINST WHAT SEARS TOLD ME ABOUT 4X4 TIRE MIXING AND THE DANGERS OF DOING SUCH.... THOUGH SEARS HAD INSTALLED ONLY ONE GOODYEAR TIRE TO REPLACE ONE OF THE FOUR BFG TIRES THAT WERE ON ANOTHER 4X4 VEHICLE I OWNED (TOYOTA)AND THE BFG'S WERE AT 3/32" AND THE GOODYEAR WAS 16/32"... THE TRANSMISSION WAS REPLACED 1900 MILES LATER AND SEARS PAID FOR THE ENTIRE TRANSMISSION REPLACEMENT COST DUE TO THEIR NEGLIGENCE IN FOLLOWING THE TRUCKS MFG PROCEDURES!
