will not shift out of second gear. check engine light stays on

  You'll need to have a transmission system diagnosis to determine what is happening. Could be a software issue or an internal issue that will require a new transmission. It may be a bad sensor too. It's just too hard to tell without performing some tests. Find a good Mercedes shop and have them check it out.
