After waiting for 2 mo. for my 328i to arrive,finally got it 2 weeks ago.For the last week it has been in the dealer repair shop b/c according to the mechanic "after working back and forth w. BMW they told us the problem might be in the transmission oil tank.....first one to see w this situation at this BMW" A new transmission will be send within the next week.
Should I demand for a brand new car or wait how the new transmission work?? on 2012 BMW 328i

Just because you ask for a new car, doesn't mean they have to give you one. you will need to check with your state's "lemon laws". if your state does have a Lemon Law, you will need to find out what must first transpire before you are eligible for a vehicle "buy back". Thats the unfortunate part about buying a new car like that. When its so new, the engineers have not had a chance to uncover what sort of problems may arise with a new system and you (the customer) essentially become part of the Research & Development! Check into your states "lemon law" and give them a chance to rectify the problem.

Perfect cars DON"T exist. this may be the only glitch you have with the car for years....BUT you can demand a new one that was built on a monday morning with the entire factory hung-over and in a bad mood and get a worse car. Hope when you got it back you could relax and enjoy it for a little while!
